Target Safety Guide and Waiver

Safety Instructions

1. General Safety:
a. Always wear safety glasses and ear protection while engaging in shooting activities. Only use safety glasses that meet or surpass the ANSI Z87.1+ standard for impact, safety, and clarity.
b. Utilize only lead ammunition to minimize the risk of target damage and ricochets.
c. Do not use steel-core or hardened ammunition as they may damage the targets and increase the likelihood of ricochet injuries.
d. Targets should be mounted to allow for a slight swing or downward angle, facilitating the safe deflection of bullet fragments, preferably using a forward angle of 20 degrees or more.
e. The Mounting Assembly Instructions, V-Stand and Multi-Target Mounting Instructions contain specific instructions concerning the use of spring and hook-style mounts. Always use a spring style target amount for left or right angled T-Posts. Hook style mounts should only be used with 90° uprights. Spring or hook-style mounts are not needed when the target is at least a twenty-degree forward angle.
f. Hook-style mounts should only be used with 90-degree upright targets.

2. Recommended Shooting Distances:
a. Pistols: Maintain a minimum distance of 10 yards.
b. Magnum Handguns: Engage at a minimum distance of 25 yards to ensure safety.
c. Rifles: Observe a minimum shooting distance of 100 yards, extending to 200 yards for high-velocity projectiles (speeds exceeding 3,000 FPS).

3. Setup Guidelines:
a. Secure the target firmly to prevent any unintended movement.
b. The vicinity of the target should be kept free from flammable substances and materials.
c. The use of BBs, pellets, airsoft guns, or any other non-approved ammunition is strictly prohibited as these can bounce back and pose a risk of injury.

4. Target Maintenance:
a. Targets displaying any signs of bending, cracks, or damage should be replaced immediately to ensure continued safety.

Liability Release and Waiver

By purchasing, possessing, or utilizing this product, you acknowledge and agree to the following terms:

1. Assumption of Risk: You recognize that engaging in shooting activities, particularly at steel targets, presents inherent risks, including potential injuries or death. As a condition of using this product, you accept and assume all such risks associated with these activities.

2. Release of Liability: You hereby release and forever discharge the manufacturer, distributor, and retailer from any claims, demands, or causes of action that you may hereafter have for injuries or damages arising out of your use of the product.

3. Indemnification: You agree to indemnify, defend, and hold harmless the manufacturer, distributor, and retailer against any and all claims, liabilities, losses, damages, costs, or expenses resulting from your misuse of the product.

4. Limitation of Warranties: The product is provided "as is," without any express warranties. Implied warranties are disclaimed to the fullest extent permitted by applicable law. You bear the sole responsibility for the safe and proper use of the product.

5 Compliance with Hazardous Substance Laws and Regulations: In recognition of the environmental and health risks posed by the use of lead and other hazardous substances in shooting activities, the purchaser agrees to comply fully with all applicable federal, state, and local laws and regulations regarding the disposal of lead and other hazardous substances. This includes, but is not limited to, adherence to the guidelines set forth by the California Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) and other state-specific hazardous substance regulations. The purchaser acknowledges that exposure to certain chemicals and metals, including lead, is known to the State of California to cause cancer, birth defects, or other reproductive harm, and agrees to take all necessary precautions to minimize exposure and properly dispose of such materials.


6. Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to this product or this agreement, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Washoe County, Nevada, before one arbitrator. The arbitration shall be administered pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

7. Governing Law and Venue: This Liability Release and Waiver and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Nevada, excluding its conflict of laws principles. The parties agree that any legal suit, action, or proceeding arising out of or related to this agreement or the transactions contemplated hereby shall be instituted exclusively in the federal courts of the United States of America or the courts of the State of Nevada in each case located in Washoe County, Nevada, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.

8. By purchasing, possessing, or utilizing this product, you acknowledge and agree to comply with the above provisions concerning the use of the product and those regarding lead disposal and hazardous substance compliance, the arbitration agreement, and the governing law and venue provisions as part of the terms of use for this product.

9. Modification and Severability: We reserve the right to modify these safety instructions and liability waiver at any time without notice. Should any provision of this waiver be deemed unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from this waiver and shall not affect the validity and enforceability of any remaining provisions.

10. Acknowledgment and Agreement to Terms. By using this product, you confirm your understanding and compliance with the above safety instructions and liability waiver, as representing a binding agreement between you and the manufacturer. If the terms of this Liability Waiver and Release are not acceptable, the product may be returned to Fix Welding LLC, dba AR500 Target Stands, within thirty (30) days from the date of purchase, provided the product is unused and in its original condition. The purchaser shall be responsible for all shipping costs associated with the return. Upon receipt and inspection of the product, Fix Welding LLC, dba AR500 Target Stands will issue a full refund of the purchase price to the purchaser. This return policy is the sole remedy for any dissatisfaction regarding the acceptance of these terms.
